The commissioned art is for your personal uses only (ex. for art collection photo galleries, printing for yourself (NOT for profit), wallpaper, decorating your web spaces with proper credit, etc).
1. Any art that I (PSI) create is my own. Unless exclusive rights are purchased, I retain all rights to use and monetize my art in any way I choose. This includes the sale of prints, digital products, online marketing, published materials, or any other merchandise.
2. You may not sell or exchange my art in any form, physical or digital, under any circumstances unless you have my express written permission AND you have paid for the right to do so. You also may not use my art in any published material, even free material, on any online marketplace
3. All references and design guidelines established by the client will recorded by me at the time I begin the sketching phase. This is to ensure there will be no attempt to change that which was requested while the commission is being completed. Moving the goalpost mid commission will accrue an additional fee for unexpected revisions.
4. No refunds/chargebacks will be permitted unless I cannot complete the commission for whatever reason, in which case I will refund the client in full.
5. You may not use my artwork under any circumstances in training AI datasets.
Granted Upon full payment, the commissioned artwork is licensed for the client’s commercial use only as specified in the project agreement (e.g., VTuber model references, streaming, merchandise associated with the project). PSI retains all copyright and ownership of the artwork. Commercial use does not transfer ownership. The client may not sell, resell, or modify the artwork outside the agreed commercial use without express written permission and payment for additional rights.
1. The artwork may not be used for AI dataset training, machine learning, or similar purposes under any circumstances.
2. Scope & Revisions. The project scope (concept directions, refinement rounds, final deliverables) will be agreed upon in writing before work begins. Any additional revisions or changes outside the agreed scope may incur an extra fee. All references and design notes provided by the client will be recorded during the project.
3. Payment & Refunds. A deposit (usually 50%) is required to begin work. Work begins only after deposit is received. The remaining balance is due upon completion and delivery of final assets. Refunds or chargebacks are only permitted if PSI cannot complete the project, in which case the client will receive a full refund of all payments made.
4. Delivery & Timeline. Estimated timelines will be provided before the project begins. PSI is not responsible for delays caused by late reference materials, missed communications, or changes requested outside the agreed scope.
5. Portfolio Use. PSI reserves the right to show the commissioned work in portfolios, social media, case studies, and marketing, unless the client requests anonymity or confidentiality in writing.
